Here are some claims that show just how bad things can get with just a moments notice.
The claimant, an employee of a private bus carrier, slipped and fell on ice inside the insured's plant. The claimant sustained a re-aggravation of a pre-existing knee condition, which required complete replacement of the knee. The claimant had no further medical treatment, but was declared permanently and totally disabled. The injury was found compensable and lifetime benefits are expected.
The claimant, a facility manager employed by a fast-food restaurant chain, suffered back injuries while installing a new roof hood on the insured's property. The claimant sustained two herniated discs and injuries to his cervical back region. Conservative care was not successful and the claimant eventually underwent a cervical discectomy. The claimant did not make a full recovery and continues to complain of radiating pain in the arms and residual radicular pain in both legs. Medical treatment includes conservative care and medication. The claimant continues attempts to relate other conditions to this work injury, which have been adjudicated as unrelated.
The claimant, a stock clerk employed by a department store, was accidentally knocked off a chair by a co-worker, injuring her neck and back against the desk as she fell backwards. The claimant sustained a cervical and lumbar strain, which was treated conservatively, and eventually with surgery. The claimant had physical and pool therapy and later entered an in-patient pain control program. The claimant also developed psychiatric overlay due to chronic pain and was found permanently and totally disabled. An orthopedic physician for the defense found only 20% of the claimant's disability apportioned to this injury, however it was determined that due to the psychiatric component, this finding would not hold up in litigation. Medical treatment includes potential morphine pump and ongoing pain management.
The claimant, a mason tender, slipped and fell 15 feet while dismantling scaffolding at a work site. The claimant sustained a vertebral fracture, resulting in C6 complete quadriplegia. It was determined that the scaffolding was not defective, but improperly erected by the insured. The claimant has limited use of the hands, but is dependant for most basic daily activities. The claimant requires attendant care and ongoing orthopedic, urological and pulmonary treatment. Additional medical benefits and allocated expenses include medication, supplies, hospitalization, biofeedback therapy, transportation and legal fees.
