Workers Compensation

Although the State of Texas does not require employers to carry Workers Compensation it does not mean it not a valuable part of a company's business insurance program.    

Did you know?

If you choose not to carry Workers Compensation (Bare) you are not allowed to use three vital legal defenses to protect you in case of being sued.

  1. Assumption of Risk – a person knew of a dangerous condition and voluntarily exposed himself or herself to it.
  2. Contributory Negligence– a person who shares a degree of fault in their injury. In some jurisdictions, the doctrine states that a victim who is at fault to any degree, including only 1% at fault, may be denied compensation entirely.
  3. Fellow Servant- prevents employees from recovering damages from employers if an injury was caused by the negligence of a coworker

 

How many times have you heard someone say "I can do this, there is no law saying I can't do it"

My response is just because you can, does not mean you should do it.

The same holds true with Workers Compensation.

Just because the State say's you don't have to carry it does not mean you should not carry it.
