Here are some claims scenarios to give you an idea of some of the type claims that happen in your industry.
The insured operates a nationwide day care program. An individual hired by the insured as a teacher was placed on leave following complaints of improper contact from the parents of a child at the day care. Investigation revealed at least 16 children were kissed, fondled, or penetrated by the insured's employee. Fourteen of the children are girls who were ages 3-4. Recent allegations include two 7 year old boys who were subject to oral sex in front of younger children. The employee has pled guilty to multiple counts of child rape and multiple counts of sexual battery of a child.
A student fell off a swing at the childcare playground. His front two teeth were knocked out. He incurred $2,000 in dental work. His mother filed a claim for the dental expenses and an additional $5,000 alleging emotional stress.
Owner arrived at their child care center to find that a fire had originated from the electrical panel. The fie damaged her child care center causing $25,000 in property damage. The center was closed down for 4 weeks to clean up the damage and they lossed income for that time period.
Mother claims that Child Care center failed to render professional services in the administration of their education program. The child had failed to identity enough colors and shapes to pass an entrance exam to a private school. The parents are suing for the cost to hire a special tutor and a refund of their tuition paid to child care center.
A disgruntled parent claims her child had bruises on his arm. When asked, her child stated his teacher hurt him. Charges filed included improper hiring, improper training of employees, and failure to protect the child from harm. Attorneys are hired to defend the school against these charges. The case is dismissed after an investigation fails to prove any abuse occurred. The center's defense cost amounted to $25,000.
The owner asked an employee, to run to the store for craft supplies for the holiday project. While en route to the store the employee rear-ends another car at a stop sign causing $4,000 worth of property damage and $9,000 in bodily injury to the other driver and automobile.
